Homicide is the killing of one human being by another either lawfully or unlawfully. Not all homicides are criminal and in violation of the law. Killing under conditions of war, capital punishment, self defense and killing to prevent a violent felony are examples of non-criminal homicides. When knowing, intentional, reckless or negligent killing takes place the action is deemed a criminal homicide. The potential consequences for the felony conviction of a homicide may include the death penalty, life in prison (with or without parole), or imprisonment for a significant period of time.

Criminal homicide has two categories: murder and manslaughter.

Murder is further categorized by degrees. First-degree murder is based on whether the murder was committed with malice and premeditation. Second-degree murder is murder committed with malice, but without premeditation.

Manslaughter is killing without malice. Various classifications of manslaughter include:

Voluntary manslaughter -Killing was intentional and provoked during the heat of passion or an argument.

Involuntary manslaughter -Killing was unintentional and occurred as a result of carelessness or recklessness.

Vehicular manslaughter -Killing was unintentional and occurred while driving due to negligence, recklessness or intoxication.
